Sal Ropolo, Managing Director of DOC SERV, says that people who are being served with a process have often proven to be very difficult, which is why they are being taken through legal process.
"Since opening our office in the Sydney CBD in 1994, at DOC SERV, we have probably come across every trick people will use to avoid service," Sal said.
"They will go to live with friends, move to another city, hide in the boot and let their wives drive them in and out of the house, move from rented house to rented house, say that they do not live at the address. They often become abusive and sometimes violent. One of our very professional operators was beaten when he tried to serve process. Copping a torrent of abuse is all part of a day's work"
"There are guidelines that limit the hours in which we can work. As a result, our operators have to be very clever when process serving. For a start, the Debt Collection Guidelines instruct to only serve process between 7 am and 9 pm unless the person is avoiding service.
"That makes process service difficult because we have the most success by finding the target at home, early in the morning and at night.
"Process should be served by a person who is not associated with the case to ensure that service cannot later be denied.
"We recently found out that a very difficult, slippery target was appearing in court on another matter. We sat in the public gallery, identified the person, followed them out of court, confronted them and served them with process. We describe what the legal process is for, and placed the documents at their feet. We prefer to serve process from hand to hand, but have the option of placing the documents at their feet or in their presence.
